Product Warranty Agreement

Wraptor, Inc. (“Wraptor”) warrants its Wraptor Tapping Safety Blanket against defective workmanship and material for a period of TWO YEARS from the later of the date of applicable invoice or shipment of the Wraptor Tapping Safety Blanket. Wraptor provides this warranty only to original purchasers who have registered the Wraptor Tapping Safety Blanket (“Purchasers”) using the registration form provided at delivery or available at: www.wraptorblanket.com. Wraptorʼs liability, and Purchaser’s sole and exclusive remedy, whether under a theory of breach of warranty, contract, tort (including negligence), strict liability, product liability, or under any other theory of law, and whether at law or in equity, is limited at Wraptor’s sole option to either: A) replacement for the same or equivalent model delivered to Purchaser at an agreed point of delivery, at no cost to the Purchaser, or B) the refund or crediting to the Purchaser of the purchase price of the Wraptor Tapping Safety Blanket. The remedy is available to Purchaser and is conditioned on Purchaser notifying Wraptor immediately upon the discovery of any claimed defect and the affected product is, upon Wraptor’s request, returned, transportation prepaid. Wraptor does not provide any warranty for any storage or carrying case, whether provided with the Wraptor Tapping Safety Blanket or otherwise.

The above warranty constitutes the entire liability of Wraptor. Wraptor shall not be liable for any, and hereby disclaims all, incidental, consequential, indirect, special, exemplary, enhanced or punitive damages arising or resulting from the sale, transportation, handling, installation, use or misuse of the products sold, including any lost profits, loss of use, property or any product losses, repair or labor costs. In no event will Wraptor be liable to Purchaser for any amounts or other obligations that are, in the aggregate, in excess of the amounts paid by Purchaser for the Wraptor Tapping Safety Blanket(s) plus shipping for any returns.

To the extent allowed by applicable law, Purchaser agrees that for all claims brought against Wraptor by or on behalf of any employee, contractor, or third party using Purchaser’s Wraptor Tapping Safety Blanket, Purchaser will hold harmless, indemnify, and defend Wraptor against such claims and associated damages, and costs including attorney fees.

Wraptor’s entire warranty is set forth in this Product Warranty, and Wraptor hereby disclaims all other warranties, expressed or implied, including any implied warranty of merchantability or fitness for any particular purpose. Wraptor has set its prices and entered into this transaction in reliance upon the provisions set forth herein including the indemnities, limitations of liability, the disclaimers of warranties and damages, and that the same form an essential basis of the bargain between the parties. The parties agree that the limitations and exclusions of liability and disclaimers specified in this Agreement will survive and apply even if one or more remedies are found to have failed of their essential purpose.

Situations Voiding Warranty

  1. Use of the product under conditions for which the product was not designed, including, but not limited to, use on pipe sizes smaller than 6ˮ, or larger than 12ˮ, improper or incomplete connection to the pipe.
  2. Failure to adhere to Wraptorʼs General Instruction Sheets and videos concerning the proper handling, installation and use of the product.
  3. Wraptor must be notified of any defect and no repair must be attempted or completed without written authorization by Wraptor.
  4. The purchaser must provide Wraptor the opportunity to view and test a blanket suspected to be defective including inspection of installation procedures and job site conditions.
  5. Warranty is null and void if any parts of the blanket are replaced without written authorization by Wraptor.
